1. Acceptance and identification of the parties

These Terms of Service ("Terms") govern access to and use of the repliboplatform ("replibo", the "platform", "we"), offered at https://app.replibo.com. By creating an account, ticking the consent checkbox at signup, connecting an Instagram profile, or otherwise using the service, you (the "Customer") confirm that you have read, understood, and fully accepted these Terms and our Privacy Policy.

If you do not agree with any clause, please do not use replibo.

Provider identification (CDC art. 6º III): the replibo service is operated by a Brazilian micro-enterprise under the Simples Nacional regime, headquartered in Brazil. The full formal identification of the provider (corporate name, Brazilian Tax ID and address) is provided upon request via the contact channel below, in accordance with CDC art. 6º III. Contact: contact@replibo.com.

Acceptance trail: at signup we record date, time, IP, user-agent, and the version of these Terms and the Privacy Policy that was accepted. The current version of this document is 2026-04-27.

2. Service description

replibo is a SaaS platform that automates public and private replies (Private Replies) to comments on Instagram professional accounts (Business or Creator), using exclusively Meta Platforms's official APIs. To operate:

  • The Customer must connect their Instagram account via Meta's official OAuth flow, explicitly authorizing the requested permissions.
  • Automations comply with Meta's policies, including rate limits and response windows.
  • The Customer is solely responsible for the rules they configure and the content sent through them.

3. Eligibility and registration

  • You confirm you are 18 years old or older and have full legal capacity.
  • The information you provide must be truthful, complete, and up to date. Keeping data outdated is your responsibility.
  • The connected Instagram account must be a professional account (Business or Creator) and linked to a Facebook Page, as required by Meta.
  • You must have legitimate right and authorization to operate the Instagram account you connect to replibo.
  • Strong password required: we enforce strength validation (zxcvbn score ≥ 3) and breached-password detection; weak passwords are rejected.

4. Acceptable use

You agree NOT to use replibo to:

  • Send spam, unsolicited bulk messaging, or content that violates Instagram Community Guidelines orMeta Platform Terms.
  • Mislead, manipulate, or harm end-users of your profiles (phishing, scams, impersonation, etc.).
  • Circumvent API limits, resell tokens, or transfer the account to unauthorized third parties.
  • Configure automations on third-party accounts without express authorization.
  • Send illegal, defamatory, discriminatory, violent, sexual content involving minors, or content that infringes intellectual property rights.
  • Reverse engineer, decompile, or otherwise attempt to access the platform's source code through unauthorized means.
  • Attempt to evade billing mechanisms (improper chargebacks, multi-account abuse of signup bonuses, etc.).

Violation of this section allows replibo to immediately suspend or terminate your account, without prejudice to any claim for damages.

5. Commercial model: credits and subscriptions

replibo operates on prepaid credits. Each automated action (DM sent, public reply, etc.) debits a specific amount of credits from the Customer's balance, per the current pricing table shown in the dashboard. The current prices, bonuses, discounts, and usage limits are published at https://app.replibo.com/dashboard/billing. We reserve the right to change them prospectively, with reasonable prior notice.

The Customer may purchase credits in two ways:

  • One-time purchase: single payment via Pix or credit card; the credit balance does not expire automatically.
  • Monthly recurring subscription:the Customer's credit card is charged automatically every cycle (monthly), at the value displayed at the time of contracting. Cycle credits are deposited after payment confirmation.

Payments are processed by the gateway AbacatePay; we do not store full card number nor CVV (those data remain with the gateway).

6. Recurring billing, plan changes, and cancellation

Explicit notice: by subscribing, the Customer authorizes automatic, recurring charges on the registered card, in the monthly amount of the current plan, until cancellation.

  • Cancellation at any time: the Customer may cancel the subscription at any time via Billing → Subscription → Cancel. Cancellation immediately stops future renewals.
  • Current cycle: credits already deposited for the last paid cycle remain available until the end of that cycle; we do not claw back credits already consumed.
  • Charge attempts:if the card fails, we will attempt new charges per the gateway's policy. Once attempts are exhausted, the subscription enters past_due; if the failure persists, it is automatically cancelled.
  • Plan change (upgrade/downgrade): mid-cycle plan changes generate a preview of the financial impact before confirmation (proportional charge, immediate credit top-up).
  • Price changes: increases in the monthly price take effect only in the following cycle and require at least 30 days of prior notice.

7. Right of withdrawal (Brazilian CDC art. 49)

Article 49 of the Brazilian Consumer Defense Code (Law 8.078/90) grants a 7-day cooling-off period for purchases made outside a physical store (including online purchases). We apply this right as follows:

  • One-time credit purchase: within 7 calendar days from the payment date, the Customer may request a full refund provided no credits from that purchase have been consumed yet. If part of the credits has already been used (service effectively performed), the refund is proportionally limited to the unused balance from that purchase. The service is considered performed for each automated action completed by replibo (DM sent, etc.).
  • Monthly recurring subscription: within 7 calendar days from the start of each billing cycle, the Customer may request a refund of the latest monthly fee, provided less than 50% of the credits deposited in that cycle have been consumed. If consumption exceeds that, the refund is proportional to the unused credits in the cycle. Subsequent renewals only generate charges if the subscription remains active.
  • How to request: email billing@replibo.com with the purchase ID (visible in Billing → Purchase history) and the reason. The refund is credited to the original payment method within 7 business days after acceptance.

The policy above preserves the Customer's legal right for credits not yet consumed and reflects the position that the service rendered (delivery of the automated message) is not refundable in itself — since it has actually been executed for the Customer's benefit.

8. Refunds, disputes, and chargebacks

  • Refunds for replibo's technical failures (duplicate charges, credits not posted after confirmed payment, etc.) are processed immediately upon verification, without prejudice to the 7-day window of CDC art. 49.
  • Chargebacks opened with the card issuer without prior attempt to contact replibo support may result in preventive account suspension while the dispute is open, due to operational risk.
  • In the event of a bad-faith chargeback, replibo reserves the right to seek judicial collection of the disputed amounts, plus court costs and attorney fees.

9. Intellectual property

All code, design, brand, logo, and documentation of replibo belong to replibo and/or its licensors. The subscription grants the Customer a limited, non-transferable, revocable license to use the platform for their own commercial purposes during the plan's term.

Content created by the Customer (rules, reply text, etc.) remains the Customer's; they merely authorize replibo to use it to operate the contracted service.

10. Privacy and data protection

Personal data processing is governed by our Privacy Policy, an integral part of these Terms. We recommend a careful read before creating the account.

11. Dependence on Meta and availability

replibo depends entirely on Meta Platforms's APIs and policies. Changes, temporary unavailability, or restrictions imposed by Meta (including permission revocation, endpoint contract changes, rate limits, or app suspension) may fully or partially affect the service, without constituting breach by replibo.

We target 99% monthly availability, excluding scheduled maintenance windows and events outside our infrastructure (Meta or AWS incidents, etc.).

12. Limitation of liability

To the maximum extent permitted by law, and without prejudice to non-waivable consumer rights, replibo shall not be liable for:

  • Loss of profits, loss of opportunity, indirect, incidental, or special damages arising from the use or inability to use the platform.
  • Decisions taken or consequences arising from automated messages configured by the Customer, who remains solely responsible for the content and rules.
  • Sanctions imposed by Meta on the Customer's account due to inappropriate content sent through the Customer's own rules.

replibo's aggregate liability, in any event, is limited to the amount effectively paid by the Customer in the 12 months immediately preceding the triggering event, except in cases of willful misconduct, gross negligence, or non-waivable consumer rights.

13. Account suspension and termination

We may suspend or terminate the Customer's account at any time, upon notice:

  • For violation of these Terms or Meta's policies;
  • For non-payment;
  • To comply with a court order or competent authority;
  • For imminent security risk to the platform or other customers.

You can terminate your account at any time via Settings → Delete account. After termination, obligations regarding confidentiality, intellectual property, and limitation of liability remain in force for the legal period.

14. Notifications and communications

Operational communications (signup verification, plan changes, charge failures, security alerts) are sent by email and/or shown in the dashboard. Marketing communications, when any, will require explicit opt-in by the Customer, and every such message will include a clear unsubscribe link.

15. Changes to these Terms

We may change these Terms at any time. Material changes will be communicated by email and/or in the dashboard with reasonable notice and will require renewed acceptance by the Customer to keep using the service. The current version is always available at https://app.replibo.com/en/terms, along with the last-updated date.

16. Governing law and venue

These Terms are governed by the laws of the Federative Republic of Brazil. For consumer-law issues, the Customer's domicile court is elected; for other matters, the court at replibo's headquarters.
